Terms and Conditions of Service

(Scope of Terms and Conditions of Service)

Article 1
The accommodation contract and related contracts concluded between Four Points Flex by Sheraton and the guest shall be subject to the provisions of these Terms and Conditions of Service, and any matters not provided for in these Terms and Conditions of Service shall be governed by laws and regulations or generally accepted practices.
2. In the event that Four Points Flex by Sheraton enters into a special contract within the scope not contrary to laws and regulations and generally accepted practices, the special contract shall take precedence, notwithstanding the provisions of the preceding clause.

(Applying for an Accommodation Contract)

Article 2
Any guest who wishes to enter an accommodation contract with Four Points Flex by Sheraton must provide the hotel with the following information.

① Name of guest
② Date of stay and expected time of arrival
③ Accommodation fee (in principle based on the standard accommodation fee in Appendix 1)
④ Other information deemed necessary by Four Points Flex by Sheraton

2. If the guest requests to extend their stay beyond the date of stay specified in Sub-Clause 2 above, Four Points Flex by Sheraton will treat the request as an application for a new accommodation contract at the time the request is made.

(Entering an Accommodation Contract)

Article 3
The accommodation contract shall be deemed to have been entered when Four Points Flex by Sheraton accepts the application under the preceding article.
2. When the accommodation contract has been entered under the provisions of the preceding clause, the guest shall pay the room deposit set by Four Points Flex by Sheraton, up to the standard accommodation fee for the period of stay, by the date specified by the hotel.
3. The room deposit shall first be applied to the accommodation fee ultimately to be paid by the guest, and if a situation occurs to which the provisions of Articles 6 and 19 apply, the deposit shall be applied in the order of penalty charges and then compensation, and the remaining amount, if any, shall be refunded at the time of payment of the fee under the provisions of Article 12.
4. If the room deposit under Clause 2 is not paid by the date specified by Four Points Flex by Sheraton under the provisions of the same clause, the accommodation contract shall become void. However, this shall only apply if the hotel has so notified the guest when specifying the due date for payment of the room deposit.

(Special Agreement Waiving the Room Deposit)

Article 4
Notwithstanding the provisions of Article 3, Clause 2, Four Points Flex by Sheraton may enter into a special agreement waiving the room deposit after the contract has been entered.
2. If Four Points Flex by Sheraton has not requested the payment of the room deposit as stipulated in Article 3, Clause 2, or has not specified a due date for the payment of the room deposit when accepting the application for the accommodation contract, the hotel shall be deemed to have entered into the special agreement under the preceding clause.

(Cooperation with Infection Prevention Measures)

Article 4-2
Four Points Flex by Sheraton may request guests to cooperate with prevention measures, as stipulated in Article 4-2, Paragraph 1 of the Hotel Business Act (Act No. 138 of 1948), for the spread of specific infectious diseases, as stipulated in Article 2-6 of the same act. In this case, guests shall comply with this request unless they have a valid reason not to do so.

(Refusal to Enter into an Accommodation Contract)

Article 5
Four Points Flex by Sheraton may refuse to enter into an accommodation contract in the following cases.

① When the application for accommodation does not comply with these Terms and Conditions of Service.
② When the hotel is fully booked and there are no rooms available.
③ When an application for accommodation has been received by false pretenses or other illegal means.
④ When the guest seeking accommodation is deemed to fall under any of the following items (a) to (c).

(a) An organized crime group as defined in Article 2, Paragraph 2 of the Law Concerning Prevention of Unjust Acts by Organized Crime Members (Law No. 77 of 1991), an organized crime group member as defined in Article 2, Paragraph 6 of the same law, an associate member of an organized crime group, or a person related to an organized crime group or other anti-social forces.
(b) A business entity or other organization whose business activities are controlled by an organized crime group or an organized crime member.
(c) A business entity with an officer(s) who is a member(s) of an organized crime group.

⑤ When the guest seeking accommodation is suspected of committing acts that violate provisions of laws and regulations, public order, or good morals in relation to his/her lodging.
⑥ When the guest requesting accommodation is, or is considered likely to be, inflicted by an infectious disease as specified in Article 4-2, Paragraph 1, Item 2 of the Hotel Business Act.
⑦ When the guest requesting accommodation is deemed to fall under any of the following items (a) to (d), or is deemed to have engaged in similar behavior.

(a) The guest is behaving in a manner that is or is likely to be a significant nuisance to other guests.
(b) The guest is likely to be a nuisance to other guests due to intoxication.
(c) The guest is deemed to have made violent demands, or made threatening, blackmailing or intimidating unreasonable demands against hotel staff. Or, the guest has made requests resulting in an unreasonable burden in relation to the accommodation (excluding cases in which the guest requests the removal of social barriers as specified in Article 8, Paragraph 2 of the Act on Promotion of Elimination of Discrimination against People with Disabilities [Act No. 65 of 2013]).
(d) The guest has repeatedly made requests that are specified in Article 5-6 of the Enforcement Regulations of the Hotel Business Act and which are deemed to impose an excessive burden on the hotel and are likely to significantly impede the provision of accommodation-related services to other guests.

⑧ When the provision of accommodation is not possible due to natural disasters, malfunctions of facilities or other unavoidable reasons.

(Guest’s Right to Cancel Contract)

Article 6
The guest may cancel the accommodation contract by notifying Four Points Flex by Sheraton.
2. If the guest cancels the accommodation contract in whole or in part due to reasons attributable to the guest (excluding cases where the hotel has requested payment of a room deposit by specifying a due date as stipulated in Article 3, Clause 2, and the guest cancels the accommodation contract prior to such payment), Four Points Flex by Sheraton may claim a penalty from the guest as listed in Appendix 2. However, if the hotel has accepted a special agreement waiving the room deposit as stipulated in Article 4, Clause 2, in accepting such a special agreement, this penalty shall only apply if the hotel has notified the guest of the obligation to pay the penalty when the guest cancels the accommodation contract.
3. If the guest does not arrive by 10 p.m. on the date of arrival (or by two hours after the expected time of arrival if the guest has specified that in advance) without notice, Four Points Flex by Sheraton may consider the accommodation contract to have been cancelled by the guest and process the matter accordingly.

(Hotel’s Right to Cancel Contract)

Article 7
Four Points Flex by Sheraton may cancel the accommodation contract in the following cases.

① When the guest is suspected of committing or has committed acts that violate provisions of laws and regulations, public order, or good morals in relation to his/her lodging.
② When the guest is deemed to fall under any of the following items (a) to (c).

(a) An organized crime group, an organized crime group member, an associate member of an organized crime group, or a person related to an organized crime group or other anti-social forces.
(b) A business entity or other organization whose business activities are controlled by an organized crime group or an organized crime member.
(c) A business entity with an officer(s) who is a member(s) of an organized crime group.

③ When the guest is deemed to fall under any of the following items (a) to (d), or is deemed to have engaged in similar behavior.

(a) The guest is behaving in a manner that is or is likely to be a significant nuisance to other guests.
(b) The guest is likely to be a nuisance to other guests due to intoxication.
(c) The guest is deemed to have made violent demands, or made threatening, blackmailing or intimidating unreasonable demands against hotel staff. Or, the guest has made requests resulting in an unreasonable burden in relation to the accommodation (excluding cases in which the guest requests the removal of social barriers as specified in Article 8, Paragraph 2 of the Act on Promotion of Elimination of Discrimination against People with Disabilities [Act No. 65 of 2013]).
(d) The guest has repeatedly made requests that are specified in Article 5-6 of the Enforcement Regulations of the Hotel Business Act and which are deemed to impose an excessive burden on the hotel and are likely to significantly impede the provision of accommodation-related services to other guests.

④ When the guest fails to comply with the prohibited activities set forth in the Rules and Regulations established by the hotel, such as smoking in bed and tampering with fire-fighting equipment (limited to rules and regulations necessary for fire prevention).
⑤ When the guest is, or is considered likely to be, inflicted by an infectious disease.
⑥ When the provision of accommodation is not possible due to natural disasters or other force majeure events.

2. When Four Points Flex by Sheraton has cancelled the accommodation contract in accordance with the provisions of the preceding clauses (excluding items 5 and 6), the hotel may charge the guest accommodation fees in accordance with the accommodation contract.

(Accommodation Registration)

Article 8
The guest must register the following information at the front desk of Four Points Flex by Sheraton on the date of arrival.

① Guest’s name, age, address and occupation
② For non-Japanese guests, nationality, passport number, port and date of entry
③ Departure date and planned departure time
④ Other particulars deemed necessary by the hotel

2. If the guest intends to pay the accommodation fee as stipulated under Article 12 by an accommodation voucher, credit card or other means that can be used instead of cash, the payment method must be presented in advance at the time of registration under the preceding clause.

(Room Usage Hours)

Article 9
The guest may use guest rooms at Four Points Flex by Sheraton from 3:00 p.m. to 11:00 a.m. the following morning. However, if the guest is staying multiple nights, the rooms may be used all day except on the date of arrival and departure.
2. Four Points Flex by Sheraton may accept requests from the guest for early check-in or late check-out. Early check-in and late check-out are limited to the following hours and the following additional fees will be charged.

① Early check-in
1:00 p.m. to 3:00 p.m. on the date of arrival, 1,100 yen per hour (tax included)
② Late check-out
11:00 a.m. to 1:00 p.m. on the date of departure, 1,100 yen per hour (tax included)
If the check-out time exceeds 1:00 p.m., an additional night’s fee will apply.

(Observance of Rules and Regulations)

Article 10
The guest must observe the Rules and Regulations posted by Four Points Flex by Sheraton within the hotel.
2. Hotel staff may enter guest rooms without the prior consent of the guest in the event of a fire or other disaster or when an emergency security need is recognized.
3. The guests may only smoke in smoking areas designated by Four Points Flex by Sheraton, regardless of the type of tobacco (traditional cigarette, electronic cigarette, other heated tobacco, etc.) used. If the guest smokes in the guest room or anywhere other than the smoking areas designated by the hotel, the hotel will charge the guest 20,000 yen (excluding tax) as a cleaning fee, and will also separately charge the guest compensation for damages as stipulated in Article 20.

(Business Hours)

Article 11
The business hours of the front desk of Four Points Flex by Sheraton are as follows. Detailed business hours of other facilities will be provided in pamphlets provided, on notices posted in various locations, and in the service directory found in guest rooms.
・Front desk/cashier service hours: 24 hours a day
2. The hours in the preceding clause may be subject to temporary changes in unavoidable circumstances. In such cases, the guest will be notified by appropriate means.

(Payment of Charges)

Article 12
The breakdown and calculation method of the accommodation and other charges to be paid by the guest is described in Attachment 1.
2. Payment of the accommodation and other charges in the preceding clause shall be made at the front desk by cash (Japanese Yen), accommodation vouchers, credit card or other alternative means at the time of the guest’s departure or when invoiced by Four Points Flex by Sheraton.
3. Accommodation charges shall be charged even if the guest voluntarily does not stay in the room after Four Points Flex by Sheraton has provided the room to the guest and made it available for use.

(Hotel Liability)

Article 13
If Four Points Flex by Sheraton causes damage to a guest in the fulfillment or non-fulfillment of the accommodation contract and related agreements, the hotel shall compensate for such damage. However, this shall not apply if the damage is not due to reasons attributable to the hotel.
2. Four Points Flex by Sheraton is covered by hotel liability insurance to cover the unlikely event of a natural disaster.

(Cases When Contracted Rooms Cannot be Provided)

Article 14
If Four Points Flex by Sheraton is unable to provide the contracted room to the guest, the hotel shall, with the guest’s consent, arrange accommodation of a similar type, to the extent possible, at other lodging facilities.
2. If Four Points Flex by Sheraton is unable to arrange accommodation at other lodging facilities, notwithstanding the provisions of the preceding clause, the hotel shall pay the guest a compensation fee equivalent to the breach of contract charges, which shall be applied to damages. However, if the inability to provide the room is not due to reasons attributable to the hotel, the hotel shall not pay the compensation fee.

(Items Held for Guests)

Article 15
In the event that items held for the guest at the front desk are lost or damaged, Four Points Flex by Sheraton will compensate for the damage in accordance with the terms and conditions of the hotel’s insurance policies, unless the loss or damage is due to a force majeure event.
2. Four Points Flex by Sheraton does not bear responsibility for the loss or damage of items brought into the hotel by the guest that are not held at the front desk. However, if the loss or damage occurs due to the negligence of the hotel, the hotel will compensate for the damage in accordance with the terms and conditions of the hotel’s insurance policies.

(Storage of Guest’s Baggage or Belongings)

Article 16
If the guest’s baggage arrives at Four Points Flex by Sheraton prior to the guest’s stay, and if the hotel has consented to do so before the baggage arrives, the hotel will store the baggage with due care, and will give the baggage to the guest at the front desk during check-in.
2. If the guest’s baggage or belongings are left behind at the hotel after the guest checks out, in principle the items will be stored for a certain period of time, including the day they were found, and will be turned over to the nearest police station.
3. The responsibility of Four Points Flex by Sheraton for the storage of the guest’s baggage or belongings in the cases of the preceding two clauses shall be in accordance with the provisions of Article 15, Clause 1 in the case of Clause 1 of this article, and the provisions of Article 15, Clause 2 in the case of Clause 2 of this article.
4. Four Points Flex by Sheraton will not accept valuables for storage at the front desk. The hotel will also not be held responsible for the loss, destruction, or theft of baggage or belongings in the guest’s room while the guest is using the room.

(Use of In-Room Safes)

Article 17
Four Points Flex by Sheraton does not guarantee the safe storage of any items stored by guests in the in-room safe provided in guest rooms, and shall not be liable for loss or damage of stored items.
2. The in-room safe may not be used to store explosives or other dangerous items, animals, or any other items that may cause damage to Four Points Flex by Sheraton or third parties.
3. The in-room safe may be used by the guest from the time of check-in to the time of check-out.
4. If any stored items are left behind in the in-room safe outside of the period of use as stipulated in the above Clause 2, Four Points Flex by Sheraton will open the in-room safe, store the items, and notify the guest in accordance with the provisions of Article 16, Clause 2. The hotel’s responsibility for storage in this case shall be in accordance with the provisions of Article 15, Clause 2.
5. If Four Points Flex by Sheraton is required by law enforcement to open the in-room safe, when it is suspected that the stored items may cause damage to the hotel or a third party, or when it is otherwise deemed necessary to open the in-room safe, the hotel may open the in-room safe or take other measures that the hotel deems necessary, even if the in-room safe is still in the period of use as stipulated in the above Clause 2. The hotel shall not be liable for any damages incurred as a result of this.

(Car Parking Liability)

Article 18
If the guest uses car parking at Four Points Flex by Sheraton, regardless of whether the vehicle’s keys are held by the hotel, the hotel is merely lending the space and is not responsible for the management of the vehicle. However, if damage is caused by the hotel’s intentional or negligent actions in managing the car parking facility, the hotel will be liable for compensation.

(Use of Computer Communications)

Article 19
The guest shall use computer communications from within the hotel at their own risk. Four Points Flex by Sheraton shall not be held liable for any damage suffered by the guest as a result of service interruptions caused by system failures or other reasons while using computer communications. Furthermore, if the guest cause damage to the hotel or a third party as a result of their use of computer communications, the guest shall be required to compensate for such damage.

(Guest Liability)

Article 20
If Four Points Flex by Sheraton suffers damage due to the guest’s intentional or negligent actions, the guest shall compensate the hotel for such damage.

(Governing Language)

Article 21
If these Terms and Conditions of Service are translated into a language other than Japanese, and there is any inconsistency or discrepancy between the terms and conditions in that language and the Japanese terms and conditions, the Japanese terms and conditions shall prevail.

(Agreement Jurisdiction)

Article 22
The Tokyo District Court shall be the court of first instance with exclusive jurisdiction over any disputes between Four Points Flex by Sheraton and the guest.

(Revisions to this Agreement)

Article 23
These Terms and Conditions of Service may be revised as determined Four Points Flex by Sheraton. When revisions are made, the revisions will be promptly announced on the hotel’s website or via other means.

The room capacity can only be exceeded for children under elementary school age, and there is a limit of one person per bed. In this case, there is no additional charge, but the guest will need to apply for this separately when making the reservation.

Appendix 2: Cancelation Fee (Article 6, Clause 2)

(Note)

1. % is the penalty rate as a percentage of the room rate.
2. If the number of days under the accommodation contract is shortened, a one-day penalty (the first day) will be charged regardless of the number of days shortened.
3. If the accommodation contract is cancelled for part of a group (10 rooms or more), no penalty will be charged if the number of people canceling is 10% (rounded up to the nearest whole number) or less of the total number of guests staying, and the cancellation notification is made 10 days or more prior to the stay (or the day of reservation is made, if that is less than 10 days prior to the stay).
4. If it is determined that guests staying on the same dates are part of the same group (10 rooms or more), the group cancellation policy will apply, and the cancellation fees as stated in the table above will be applicable.
